MARS HORSECARE US, INC. & MARYLAND 5 STAR: TAILGATING SPOT SWEEPSTAKES OFFICIAL RULES

The Mars Horsecare US, Inc. & Maryland 5 Star: Tailgating Spot Sweepstakes (the “Sweepstakes”), is sponsored by Mars Horsecare US, Inc. and Maryland Five Star (each, a “Sponsor”) and their respective affiliates (together with Sponsors, the “Sweepstakes Entities”), and will be administered by Maryland Five Star (“Administrator”), whose decisions relating to this Sweepstakes will be final and binding on all entrants.  By entering, you agree to be bound by all of the terms and conditions of these Official Rules. 

You are giving your consent to receive emails regarding marketing and news communications from Sponsors and their respective affiliates and the prize sponsors, possibly including special offers, the latest products, and more. You can unsubscribe from a Sponsor’s communications at any time after you receive the first communication from that Sponsor, by following the directions included with that communication.  You are providing your information to the Sponsors, and it will be used in accordance with these Official Rules and each Sponsor’s respective privacy policy(ies). 

1. Who Can Enter: To enter, you must be 21 years of age or older and residing in the United States (50 states + District of Columbia) on the date your entry is submitted. Limit: One (1) entry per person, per email address. Employees, vendors, contractors, and agencies of Sponsor, the Administrator, or any of the Sweepstakes Entities, and any members of their immediate families or individuals living in the same household, are not eligible to enter or win the Sweepstakes. 

2. Sweepstakes Period: The Sweepstakes will start on Friday, September 12, 2025 at 12:00 noon Eastern Daylight Time, and will end on Friday, September 26, 2025 at 11:59 pm Eastern Daylight Time (the “Sweepstakes Period”). The Sponsor’s time clock will be used to determine the Sweepstakes Period start and end date/time, and will be final. 

3. How To Enter: To enter, during the Sweepstakes Period, a) follow BUCKEYE™ Nutrition, Mars Equestrian, and Maryland 5* on Instagram, b) share the Sweepstakes Instagram post to your Instagram story, and c) complete and submit the Official Entry Form that will be linked in the BUCKEYE Nutrition bio on Instagram.  You must agree to attend and fill the tailgating spot at the Maryland Five Star being held on October 18, 2025 at Timber Field, 4600 Telegraph Rd, Elkton, MD 21921 (the “Event”). Personal information collected for the Sweepstakes will be used to communicate with potential winners, and for emails from the Sponsors and their respective affiliates, and the prize sponsors, regarding marketing and news communications, as provided in these Official Rules. 

Alternative Means of Entry:  Instead of entering as set forth above, you may enter the Sweepstakes by sending an email to: Buckeye.Nutrition@effem.com, with the subject: Mars Horsecare US, Inc. & Maryland 5 Star: Tailgating Spot Sweepstakes, and including your first and last name, street address, telephone number, email address, and confirmation that you plan to attend and will use the tailgating spot at the Event. To be an eligible entry, your email must be received by Sponsor within the Sweepstakes Period, as indicated by the date and time stamp on the email that is received by Sponsor. Sponsor is not responsible for incomplete, lost, late, delayed, or misdirected emails, or any failure of the internet, any email, wireless, or internet service provider, software, hardware, computer application or any act or omission of any third party, that results in your email not being received by Sponsor during the Sweepstakes Period. 

While it is free to enter, if entering via your wireless mobile device (only available via participating wireless carriers), data rates may apply for data usage, possibly including each email or message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in the Sweepstakes. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions. The Sponsor is not responsible for any charges.

4. Winner Selection, Notification and Verification:  The potential winner will be selected at random using a random generator on or about  Monday, September 29, 2025, from all eligible entries received during the Sweepstakes Period. The potential winner will be contacted by email and must respond by reply email within 24 hours to claim their prize.  The potential winner must properly and truthfully complete, sign and return documents confirming their eligibility, publicity and liability releases, and an IRS form W-9 the “Winner Verification Documents”), to Sponsor within three (3) calendar days after Sponsor’s notification, in order to receive the Prize. Only upon Sponsor’s receipt and verification of the winner, will the potential winner be the winning entrant (“Winner”). The Winner will be announced on Sponsor’s Instagram story, Facebook story, and within the comments of that post.  If the potential winner does not timely respond to Sponsor’s notification, or does not timely return completed and signed Winner Verification Documents, the potential winner forfeits the Prize and a new potential winner will be selected, time permitting. This process will be repeated until a Winner is verified. Sponsor reserves the right not to award the Prize if no potential winner is verified prior to the Event, or to award the Prize to a randomly selected potential winner chosen from the eligible entries. Acceptance of the Prize shall constitute the Winner’s consent to each Sponsor’s and Prize Sponsor’s use of Winner’s name, city, state, likeness, photo, avatar, and/or Prize information in connection with this Sweepstakes, or for other marketing, promotional, advertising, publicity or other purposes, in any manner, and in any media now known or hereafter devised, throughout the universe, in perpetuity, royalty-free, without restriction and without the need for further consent, payment, notice, permission or otherwise, unless prohibited by law. 

Please be aware of potential fraud and copycat accounts. We will never ask for any method of payment, shipping information, or personal information via the comments on the daily posts.

5. Prize:  One (1) lucky winner will win the Grand Prize (“Prize”), which includes:

• One (1) tailgating spot stocked with a table and chairs, at the Timber Field Overlook for Cross Country at the Maryland 5* Star, taking place at 4600 Telegraph Rd, Elkton, MD 21921, on Saturday, October 18, 2025, with gates open at 8:00AM EDT and tailgating access at 7:00AM EDT, with an incredible view of the entirety of the northern half of Timber Field, and just a short walk from the Main Arena competition.  

• One (1) charcuterie and champagne picnic basket ;

• Six (6) General Admission tickets; and

• Four VIP parking passes.

The Grand Prize does not include any transportation, accommodations, meals, or incidentals.  WITHOUT LIMITING THE FOREGOING, THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSORS, ADMINISTRATOR, AND PRIZE SPONSOR HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.  The Sweepstakes Entities are not responsible for any malfunction, defect, injury, death, or failure of the Prize or arising out of or related to your use of the Prize. 

6. Conditions of Participation; Release of Liability.  By entering, you agree to abide by the terms and conditions set forth in these Official Rules.  You agree that the decisions of the Sponsors and Administrator will be final and binding on you, and you waive any right you might have to appeal the decisions of the Sponsors or Administrator.  

A. Transmission of Information. The Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information, whether caused by an entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in this Sweepstakes; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines, computers, or network hardware or software, failure of email delivery or delivery to a spam or ‘junk’ emailbox; (3) unauthorized human intervention in any part of the entry process or this Sweepstakes; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of this Sweepstakes, the uploading, the processing or random selection of entries, the announcement of the Prizes or in any Sweepstakes-related materials; (5) late, lost, garbled, misdirected, inaccurate, incorrect, undeliverable, damaged or stolen entries or; (6) costs associated with claiming or redeeming the Prize; nor (7) loss or damages resulting from an entrant’s connection to the internet via any of the websites contained herein. Sweepstakes Entities are not responsible for any incorrect, mis-transcribed, misdirected or undeliverable entries, e-mail transmissions, incorrect announcements of any kind, or for any technical problems of any kind, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Sponsor assumes no responsibility for late, lost, incomplete, inaccurate or damaged entries, or undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. Proof of submitting entries will not be deemed to be proof of receipt by Sponsors or Administrator.

 B. Reservation of Rights. The Sponsors reserve the right to cancel, suspend, and/or modify this Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of this Sweepstakes, as determined by Sponsors in their sole discretion. If terminated, Sponsors may, in their sole discretion, determine a winner from among all non-suspect, eligible entries received up to the time of such action or as otherwise deemed fair and appropriate by Sponsors and the Administrator. Administrator, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner, and to void all associated entries. The preceding in no way precludes Sponsors from taking other actions against such individuals so as to protect their respective rights. A Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance does not constitute the waiver of such provision. Prize Sponsor, in its sole discretion, reserves the right to substitute any prize with a prize of equal or greater value.

C. Release and Indemnity. By participating, each entrant indemnifies, releases and agrees to hold harmless the Sweepstakes Entities, their respective parents, affiliates and subsidiaries, and other entities involved in the development / production / administration of the Sweepstakes, and the directors, officers, agents, representatives, shareholders, employees, contractors, successors and assigns of any of the above organizations, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of any prize and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery.

7. Force Majeure. If, for any reason, the Event or the Sweepstakes (or any part thereof) is delayed, postponed or cancelled, or is not capable of running as planned by reason of computer virus, bug, system malfunction, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, pandemic, governmental regulation or any other causes beyond the control of Sponsors which, in their sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsors reserve the right at the Sponsors’ sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes by selecting the prize winner for affected Sweepstakes Period drawing from among all eligible entries received for such affected Sweepstakes Period drawing, prior to the action taken by Sponsors or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsors in their sole discretion. 

8. Dispute Resolution/Governing Law. To the fullest extent permitted by law, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or this Sweepstakes shall be filed exclusively in the federal or state courts sitting in Dalton, Ohio, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action; (b) any such action shall be resolved individually, NOT as part of a class action; (c) any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred in entrant’s entry into the Sweepstakes (if any), but shall NOT include attorneys’ fees, special damages, punitive damages, or consequential damages of any kind (including lost wages). These Official Rules and this Sweepstakes shall be governed by the internal, substantive laws of the state of Tennessee, without regard to principles of choice of laws/conflict of laws.

9. Use of Data. Sponsors, Administrator, and any Prize Sponsor will be collecting personal data about entrants online, in accordance with their respective privacy policies. Please review Sponsor's and BUCKEYE Nutrition’s privacy policy at https://www.mars.com/privacy and Administrator’s privacy policy at https://www.maryland5star.us/privacy-policy/. By participating in the Sweepstakes, you agree to the collection and use of your personal information and acknowledge that you have read and accepted each Sponsor’s, Administrator’s, and Prize Sponsor’s privacy policies. Notwithstanding the foregoing, all entrants acknowledge that if they are chosen as a Winner, certain of their personal information may be disclosed to third parties, including, without limitation, on a winner’s list. All personal information submitted as part of the Sweepstakes may be shared by and between the Sweepstakes Entities and their affiliates and partners, and such affiliates and partners will use disclosed personally identifying information in accordance with their respective online privacy policies.

10. The Sweepstakes may be held, hosted, or promoted on social media platforms including but not limited to Twitter/X, Instagram, Facebook, and any affiliated sites (the "Media Platforms"). By participating in the Sweepstakes, you hereby agree to adhere to the Terms of Use, Privacy Policy and any other terms governing access to the Media Platforms, their servers, or their content. Sweepstakes is not sponsored or endorsed by the Media Platforms. By participating in this Sweepstakes, you agree to release the applicable Media Platforms from any claims, liabilities, or damages arising out of or in any way connected with this Sweepstakes. Except where prohibited by law, entry and acceptance of a Prize constitutes permission to use Winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

11. Winner Name: For the name of the Winner (available after October 20, 2025), send a self-addressed, stamped envelope to the Administrator, for receipt by Administrator not later than November 20, 2025 at the following address:  Maryland 5* c/o Mars  Horsecare US, Inc., 330 East Schultz Avenue, Dalton, Ohio 44618, Attn: MARS  HORSECARE US, INC. & MARYLAND 5 STAR: TAILGATING SPOT SWEEPSTAKES WINNER LIST.
